Agreement

  1. Public Right-of-Way Encroachment Permit. The Applicant has acquired an Encroachment Permit in accordance with West Jordan City Code for the property located at (“Property”).
  2. Standards. In performing any work pursuant to any permit, Applicant shall comply with all applicable law, including the City code and Utah occupational safety and health laws, in addition to the City’s design and specification standards, City approved plans, this agreement, and any requirements or limitations the City, in its sole discretion, deems appropriate.
  3. Permit Requirements. Applicant shall provide the following: (1) Demolition plans showing location of structure and location of all utilities, including electric, gas, water, and wastewater; and (2) detailed drawings indicating how and where the water and wastewater services will be terminated.
  4. On-Site Permit Requirements. A copy of the City’s current trench detail, and approved plan of the Work, and approved traffic control plan, a signed copy of this Permit, and a copy of the City’s Public Improvement Standards, Specifications, and Plans shall be on the work site at all times. Applicant shall grant the City access to these papers at all times.
  5. Suspension of Work/Revocation of Permit. If Applicant fails to comply with applicable laws and regulations, City standards and specifications, or other limitations or instructions from the City, or if there is an existing risk to the health and safety of the public, the City may suspend the work until the violation is corrected. If Applicant fails or refuses to promptly comply, the City may revoke any permit granted to the Applicant.
  6. Public Communication. Applicant shall promptly respond to concerns raised from adjacent property owners.
  7. Permit Period/Extensions. If granted, a permit is valid forty-five days (45) from issue date. The City may, in its sole discretion, grant an extension of time after receipt of a written request from the Applicant to the City Engineering Department. A request must be submitted five (5) working days before the expiration date of the permit.
  8. Indemnification. Applicant shall defend, indemnify, hold harmless the City and its officers, agents, employees, and volunteers from all claims, liabilities, actions, causes of action, suits, demands, warranties, rights, losses, damages, punitive damages, costs, expenses, and compensation of any kind and nature whatsoever, and whether known or unknown, foreseen or unforeseen, and whether based on tort, strict liability, warranty, contract, statute, common law, or other theory which any individual now has or which may hereafter accrue on account of, resulting from, or in any way arising out of the City’s issuance of a permit or any work performed thereunder.
