NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about Monday, June 14, 2021, the City of West Jordan will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake the following project:
Project/Program Title: Emergency Home Repair, Maintenance, and Accessibility (2020-2024)
Purpose: Housing activities to maintain existing housing for qualifying low- to moderate-income households.
Location: West Jordan, Utah (citywide) – Specific addresses are not known at this time, a site-specific review will be completed as specific properties are identified.
Description: This project/program covers residential home maintenance, repair, rehabilitation, and accessibility improvements over a five-year term (Program Years 2020-2024) and including multiple subrecipients. It is anticipated that the City will allocate approximately $180,000 per year in CDBG funds, for a total of $900,000. The project is expected to benefit 60 dwelling units per year, and a total of nearly 300 dwelling units. Activities are not expected to be significant, with the average funding at approximately $3,082 per unit, and not likely to exceed $15,000 for any one unit. The geographical boundaries include the entire City boundary. Activities shall not include the addition of dwelling units, buildings of over four units, a change of use from residential, activities that exceed 75% of the replacement cost, and the expansion of a building footprint or ground disturbance in a wetland.
Environmental Review: As specific locations have not yet been identified, a two-step (tiered) environmental review process will be conducted. Based on the scope of work, a broad level review was conducted, and it was determined that compliance is achieved with related laws and authorities for the following compliance factors: Coastal Barrier Resources, Air Quality, Coastal Zone Management, Endangered Species, Explosive and Flammable Hazards, Farmlands Protection, Floodplain Management, Sole Source Aquifers, Wetlands Protection, Wild and Scenic Rivers, and Environmental Justice. A site-specific review will be conducted with each site for those laws and authorities not addressed in the broad level review, specifically the following compliance factors: Airport Hazards, Flood Insurance, Contamination and Toxic Substances, Historic Preservation, and Noise and Abatement Control.
Level of Environmental Review Citation: Categorical Exclusion Subject to Federal laws and authorities cited in Section 58.5 (CEST), Pursuant to 24 CFR Part 58.35(a).
Mitigation Measures/Conditions/Permits (if any): No mitigation measures or permits are anticipated.
The activities proposed are categorically excluded under HUD regulations at 24 CFR 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR 58.35(a). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the West Jordan City Community Development Office at 8000 South Redwood Road, West Jordan, UT and may be examined or copied weekdays 8:00 a.m. to 5:00 p.m.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the West Jordan Community Development Office at 8000 South Redwood Road, West Jordan UT 84088. All comments received by June 14, 2021 will be considered by the City of West Jordan prior to authorizing submission of a request for release of funds.
ENVIRONMENTAL CERTIFICATION
The City of West Jordan certifies to HUD that Dirk Burton, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities under NEPA and related laws and authorities and allows the City of West Jordan to use HUD funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of West Jordan’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of West Jordan; (b) the City of West Jordan has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec.58.76) and shall be addressed to the HUD Denver Regional Office at 1670 Broadway, Denver, CO, 80202-4801. Potential objectors should contact HUD to verify the actual last day of the objection period.
