What is a Variance?

A variance is a modification, granted by the Land Use Appeal Authority, of a zone’s numerical or quantitative requirement (e.g., height, bulk, area, width, setback, separation) set forth in West Jordan City Code §13‑7G and Utah Code §10‑9a‑702. The Authority may grant a variance only if all five criteria are satisfied: (1) literal enforcement causes an unreasonable hardship not necessary to carry out the ordinance’s purpose; (2) special circumstances attach to the property that do not generally apply to others in the same district; (3) granting the variance is essential to enjoyment of a substantial property right possessed by other property in the same district; (4) the variance will not substantially affect the general plan and will not be contrary to the public interest; and (5) the spirit of the zoning ordinance is observed and substantial justice done.

The Land Use Appeal Authority convenes as needed. Submit a complete application, required materials, and a non‑refundable filing fee per the City’s consolidated fee schedule. A public hearing date will not be set until the application is complete and all materials and fees are received.

Variance Request Application — Submittal Procedure

Variance applications must be completed and submitted at least 30 days prior to the requested hearing date. The Appeal Authority meets as needed at West Jordan City Hall, 8000 South Redwood Road.

  1. Complete forms: Application Form and Applicant’s Affidavit. If the property owner differs from county tax rolls, verify ownership (certified deed, real estate contract, or other proof). If someone other than the owner presents the application, complete the Agent Authorization Form.
  2. Fees: Pay the non‑refundable filing fee (per the City’s adopted consolidated fee schedule).
  3. Site plan (8½″ × 11″, drawn to scale) includes: (a) North arrow & scale; (b) Street names/numbers; (c) Property lines, existing/proposed buildings, accessory structures, rights‑of‑way, easements, fences, with distances from property lines and to adjacent structures; (d) Sidewalks, curbs, gutters, landscaping, parking; (e) Elevation drawing (to scale) showing all existing & proposed elevations.
  4. Inquiry sheet: Provide complete written answers to the attached questions. Applicant or authorized agent must attend the meeting and present the case; applicant bears the burden of proof to satisfy statutory requirements.
