1. Definitions

“Application” includes the Development Services Application, this Affidavit, and all information provided by the Applicant, Consultant, Property Owner(s), or Supporting Parties. “Applicant” is named on the Application Form. “Property Owner” holds legal title to the Property. “Property” is identified below.

4–8. Affirmations
  1. Information is True and Correct – The information in this Affidavit and the Application Form is true and correct; the Property Owner will use best efforts to keep contents accurate and current.
  2. Owner’s Consent – The Property Owner approves the contents of the Application Form and consents to the Applicant pursuing approval.
  3. City’s Right to Contact – The City may contact the Property Owner directly to verify information in the Application.
  4. Contact is not Interference – Such contact shall not be considered interference with the Property Owner’s dealings with the Applicant.
  5. Incorrect/Untrue Information – If any information is untrue or incorrect, the City may consider the Application void ab initio, has no obligation to process it, any commitments or development rights may be void ab initio and unenforceable, and the Property Owner shall indemnify and hold the City harmless for costs or claims resulting from false or incorrect representations.
  6. Notice of Changed Event – The Property Owner must notify the City in writing within two (2) business days of any Changed Event occurring after the Applicant executed the Application Form that alters authorization or renders any representation untrue, incorrect, or inaccurate.
